TERMS OF USE

Thank you for visiting the Law Offices of Nancy L. McCullough (“LNLM”) website, located at www.mcculloughlawoffices.com (the “Website” or “Site”). These terms of use constitute a binding agreement (“Agreement”) between LNLM and any person accessing this website (“Site User” or “you”), to ensure a clear understanding of the relationship arising from your use of the Site and any services LNLM may offer through it.

This Agreement sets forth both the terms and conditions governing your use of the Site. You agree to abide by all of the terms of this Agreement as a condition of your continuing use of, or access to, the Site.

BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AS SET FORTH BELOW. IF YOU DO NOT WISH TO BE SO BOUND, PLEASE DO NOT CONTINUE ACCESSING THE SITE.

1. Website

The Website and all material included on it is proprietary to LNLM, and is protected by the copyright laws of the United States and various international treaties governing intellectual property. Your access to the Website is by license, which is grated solely for your non-exclusive personal use, subject to the terms, conditions and limitations of this Agreement. LNLM may, as its sole discretion, discontinue providing access to the Site at any time and for any reason, with or without notice, including (by way of example only) by reason of: (a) equipment malfunctions; (b) periodic maintenance or repairs; or (c) causes beyond the control of LNLM.

2.  Site Not Intended as Legal Advice; No Attorney-Client Relationship Formed by Use

The information and content contained on the Website is general in nature, and is provided for information purposes only. It is not to be relied upon, nor construed as, providing legal advice or legal opinions about any specific issue or factual circumstance, and LNLM assumes no liability or responsibility for any errors or omissions in the content of this Website. LNLM does not represent or warrant that the contents of the Site are complete, accurate or up to date.

Your accessing the Site, nor receiving information from it, does not create an attorney-client relationship between LNLM and you. You must consult specifically with an attorney qualified to practice in your state in the event that you seek legal advice, or before relying upon any information or content contained on the Site.

Transmission of information between LNLM and you is not intended to, and will not, form an attorney-client relationship between LNLM and you. An attorney-client relationship will not be created unless and until an authorized representative of LNLM expressly agrees in a written engagement letter signed by LNLM and you that LNLN will undertake an attorney-client relationship with You (or as otherwise provided by law or regulation).

You should not transmit any confidential or sensitive information to LNLM unless and until you have received written acceptance from LNLM to undertake the legal services you may request. Until such acceptance, no formal attorney-client relationship has been established between LNLM and you, it being understood and agreed by Site User that LNLM does not agree to accept and/or maintain the confidentiality of any unsolicited information sent to LNLM unless a formal attorney-client relationship exists.

Without limiting the generality of the foregoing, please note that an attorney-client relationship will not commence until relevant information concerning potential conflicts of interest are evaluated (it being understood and agreed that even in the absence of any conflict of interest, LNLM may decide not to enter into an attorney-client relationship with you).

3. Security and Privacy

LNLM will not monitor, edit, or disclose any personal information about you, including your name, address, email, phone number, or your use of the Website, without your prior consent, unless LNLM has a good faith belief that such action is necessary to: (i) comply with the legal process or legal requirements of any government agent or authority; (ii) protect and defend the rights or property of LNLM; (iii) enforce this Agreement; (iv) protect the interests of users or the Website other than You or any other person; or (v) operate or conduct maintenance and repair of LNLM’s services or equipment, including the Website.
